These Driver Terms and Conditions (“Terms”) govern your access to and use of the driver-facing platform operated by Budget Ride Pty Ltd (“Budget Ride”, “we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms and each State Schedule that applies to the jurisdictions in which you operate.

1. Definitions and structure

1.1 Platform

Platform means the Budget Ride driver-facing mobile application, software interfaces, and systems made available to you for the purpose of accessing, accepting, and providing booked hire or rideshare services, including backend systems that directly support driver functionality. For clarity, the Platform does not include any rider-facing application or interface.

1.2 State Schedules

Each State Schedule forms an integral and operative part of these Terms and sets out mandatory jurisdiction-specific legal and compliance requirements.

1.3 Integration and precedence

  • Compliance with each applicable State Schedule is a condition of eligibility to access and continue using the Platform in that jurisdiction.

  • Where there is any inconsistency between these Terms and a State Schedule, the State Schedule prevails for that jurisdiction.

  • A breach of a State Schedule is deemed a breach of these Terms.

2. Independent contractor relationship

You acknowledge and agree that:

  • you operate as an independent contractor, not an employee, agent, partner, or representative of Budget Ride

  • you are solely responsible for how you provide Services

  • nothing in these Terms creates an employment, partnership, franchise, or joint venture relationship

3. Eligibility and conditional access

3.1 Jurisdiction-based eligibility

Your eligibility to access and use the Platform is conditional on ongoing compliance with:

  • these Terms, and

  • each State Schedule applicable to the jurisdictions in which you operate.

3.2 Verification

Budget Ride may verify your eligibility, licences, authorisations, training, vehicle status, and compliance at any time, including through third-party systems.

4. Compliance with law and schedules

You must comply with:

  • all applicable transport, road safety, and passenger service laws

  • all obligations in the relevant State Schedule(s)

  • any reasonable compliance directions issued by Budget Ride to meet regulatory requirements

Failure to comply constitutes a material breach.

5. Ongoing eligibility and notification duties

You must immediately notify Budget Ride if:

  • any licence, accreditation, authority, approval, or authorisation required under a State Schedule expires, is suspended, cancelled, or varied

  • you become ineligible to operate in any jurisdiction

  • you are charged with or convicted of an offence that may affect eligibility

Failure to notify is a material breach and may result in immediate suspension.

6. Driver licences, accreditations, and authorities

You must hold and maintain all driver licences, accreditations, and authorities required by the State Schedule(s) applicable to where you operate.

You must carry evidence of those credentials where required by law.

7. Vehicles, registration, and approvals

You must ensure that any vehicle used to provide Services:

  • is lawfully registered

  • is approved, licensed, or authorised for passenger transport as required by the applicable State Schedule

  • has current compulsory third-party insurance and any required declarations

  • meets all jurisdiction-specific eligibility requirements

8. Limitation of Liability

You must ensure that:

  • all inspections required by the applicable State Schedule are completed

  • inspection certificates remain current

  • vehicles are safe and roadworthy at all times

You must immediately cease providing Services if a vehicle becomes unsafe or non-compliant.

9. Vehicle maintenance responsibility

You are solely responsible for maintaining vehicles in accordance with:

  • manufacturer standards, and

  • applicable State Schedule requirements.

Budget Ride does not inspect, maintain, or repair vehicles and relies on your compliance.

10. Records and evidence

You must retain records required by law or a State Schedule, including inspection, maintenance, insurance, and training records, and provide them to Budget Ride on reasonable request.

11. Identification and signage

Where required by an applicable State Schedule, you must:

  • display approved identification or signage while providing Services, and

  • remove identification or signage when not in service.

Failure to comply is a breach of these Terms.

12. Fares, disclosures, and receipts

You must comply with all fare disclosure, estimate, and receipt requirements imposed by applicable State Schedules and law.

13. Mobile phone use and distraction

You must comply with all road rules relating to mobile phone use, distraction, and safe operation.

14. Fatigue, fitness, drugs, and alcohol

You must not operate while fatigued, impaired, or under the influence of alcohol or drugs.

You must immediately cease providing Services if you are unfit to drive.

15. Safety incidents and reporting

You must promptly report safety incidents, accidents, or material complaints to Budget Ride and cooperate with investigations.

16. Training and competency

You must complete:

  • all mandatory training required by law or a State Schedule, and

  • any additional compliance or onboarding training reasonably required by Budget Ride.

Where training is enforced through a third-party system, completion records may be relied upon as evidence of compliance.

17. Complaints, investigations, and regulator cooperation

You must cooperate with:

  • complaints handling

  • investigations

  • regulator inquiries

Budget Ride may disclose information to regulators where required or permitted by law.

18. Monitoring and data use

Budget Ride may collect, use, and retain information for compliance, safety, audit, and operational purposes.

19. Suspension and termination

19.1 Immediate suspension

Budget Ride may immediately suspend or terminate your access to the Platform if you:

  • breach these Terms

  • breach any applicable State Schedule

  • fail to maintain eligibility or compliance

  • present a safety or regulatory risk

19.2 No compensation

No compensation is payable for suspension or termination arising from compliance or safety enforcement.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia.

State Schedules (Integrated by Reference)

  • Schedule 1 – New South Wales

  • Schedule 2 – Queensland

  • Schedule 3 – Victoria

  • Schedule 4 – Australian Capital Territory

  • Schedule 5 – Tasmania

Each Schedule is mandatory for operations in that jurisdiction and forms part of these Terms.

Schedule 1 – New South Wales

This Schedule applies only when you operate, accept bookings, or provide booked hire or rideshare services in New South Wales.

This Schedule forms an integral part of the Driver Terms and Conditions. Compliance with this Schedule is a condition of eligibility to access and use the Platform in New South Wales.

Where there is any inconsistency between this Schedule and the Driver Terms, this Schedule prevails for New South Wales operations.

1. Regulatory framework

1.1 In New South Wales, booked hire and rideshare services are regulated under the point to point transport framework.

1.2 When operating in New South Wales, you must comply with all applicable laws, including but not limited to:

  • the Point to Point Transport (Taxis and Hire Vehicles) Act 2016 (NSW)

  • the Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017 (NSW)

  • applicable road transport and road safety legislation.

2. Passenger Transport Licence Code (PT Code)

(for the purposes of clauses 3, 6 and 19 of the Driver Terms)

2.1 To lawfully provide booked hire or rideshare services in New South Wales, you must hold and maintain a current Passenger Transport Licence Code (PT Code) recorded against your NSW driver licence.

2.2 Your PT Code must:

  • be current and valid at all times

  • not be suspended, cancelled, removed, or subject to conditions that prevent you from providing services.

2.3 You must immediately notify Budget Ride if:

  • your PT Code expires, is suspended, cancelled, or removed

  • you become ineligible to hold a PT Code

  • you are charged with or convicted of an offence that may affect your PT Code eligibility.

2.4 Budget Ride may verify your PT Code status at any time and may immediately suspend or terminate your access to the Platform for New South Wales operations if your PT Code is not valid.

3. Vehicle registration and insurance

(for the purposes of clauses 7, 8 and 19 of the Driver Terms)

3.1 Any vehicle used to provide booked hire or rideshare services in New South Wales must:

  • be lawfully registered, and

  • be insured with current Compulsory Third Party (CTP) insurance.

3.2 You must ensure that any required declarations or disclosures relating to the use of the vehicle for rideshare or booked hire services are correctly made to the relevant insurer or authority.

3.3 You must not provide services using a vehicle that is unregistered, uninsured, or otherwise non-compliant.

4. Annual safety checks

(for the purposes of clauses 8 and 19 of the Driver Terms)

4.1 Vehicles used to provide booked hire or rideshare services in New South Wales must undergo an annual safety check in accordance with NSW point to point transport requirements.

4.2 Safety checks must be completed by an Authorised Inspection Scheme (AIS) inspection station.

4.3 You must ensure that:

  • the safety check remains current at all times, and

  • any safety defects are rectified before the vehicle is used to provide services.

4.4 You must not provide services if an annual safety check has expired, failed, or the vehicle is unsafe.

4. Annual safety checks

(for the purposes of clauses 11 and 19 of the Driver Terms)

5.1 When a vehicle is being used to provide booked hire or rideshare services in New South Wales, it must display a retroreflective sign in accordance with NSW point to point transport requirements.

5.2 Budget Ride may provide the required retroreflective sign (including as part of onboarding). However, you are responsible for ensuring that:

  • the sign is displayed whenever required, and

  • the sign is positioned and used in compliance with NSW requirements.

5.3 You must remove or cover the sign when the vehicle is not being used to provide booked hire or rideshare services.

5.4 Failure to correctly display the required sign while in service is a breach of these Terms.

6. Driver conduct and safety

(for the purposes of clauses 14 and 19 of the Driver Terms)

6.1 When providing services in New South Wales, you must:

  • comply with all road safety laws

  • not operate while fatigued or otherwise unfit to drive

  • not operate while under the influence of alcohol or drugs.

6.2 You must immediately cease providing services if you are impaired or fatigued.

7. Complaints, investigations and regulator cooperation

7.1 You must cooperate with any reasonable request by Budget Ride relating to:

  • passenger complaints

  • safety incidents

  • investigations by Transport for NSW or other authorities.

7.2 Budget Ride may provide information to NSW regulators where required or permitted by law, including where access to the Platform is suspended or terminated for safety or compliance reasons.

8. Enforcement (New South Wales)

8.1 Budget Ride may immediately suspend or terminate your access to the Platform for New South Wales operations if you:

  • do not hold a current PT Code

  • fail to maintain a compliant vehicle

  • fail to complete or maintain annual safety checks

  • fail to display required signage

  • otherwise breach this Schedule or applicable NSW law.

8.2 No compensation is payable for suspension or termination arising from New South Wales–specific compliance enforcement.

Schedule 2 – Queensland

This Schedule applies only when you operate, accept bookings, or provide booked hire or ride-booking services in Queensland.

This Schedule forms an integral part of the Driver Terms and Conditions. Compliance with this Schedule is a condition of eligibility to access and use the Platform in Queensland.

Where there is any inconsistency between this Schedule and the Driver Terms, this Schedule prevails for Queensland operations.

1. Regulatory framework

(for the purposes of clauses 3, 6 and 19 of the Driver Terms)

1.1 In Queensland, ride-booking and booked hire services are regulated under the personalised transport framework.

1.2 When operating in Queensland, you must comply with all applicable Queensland laws and requirements administered by the Department of Transport and Main Roads (TMR), including the Transport Operations (Passenger Transport) Act and Regulation.

2. Driver Authorisation (DA – BHTX)

2.1 To lawfully provide booked hire or ride-booking services in Queensland, you must hold and maintain a current Driver Authorisation (DA) with the Booked Hire / Taxi (BHTX) category.

2.2 Your DA must:

  • be current and valid at all times

  • include the BHTX category

  • not be suspended, cancelled, expired, or subject to conditions that prevent you from providing services.

2.3 You must carry evidence of your DA (physical or electronic) while providing services.

2.4 You must immediately notify Budget Ride if:

  • your DA expires, is suspended, cancelled, or varied

  • you become ineligible to hold a DA

  • you are charged with or convicted of an offence that may affect your DA eligibility.

2.5 Budget Ride may verify your DA status at any time and may immediately suspend or terminate your access to the Platform for Queensland operations if your DA is not valid.

3. Mandatory driver training (WorkPro)

(for the purposes of clauses 6, 16 and 19 of the Driver Terms)

3.1 Queensland law requires drivers providing booked hire services to complete mandatory training covering:

  • anti-discrimination awareness, including sexual harassment

  • disability awareness.

3.2 Budget Ride enforces this requirement by requiring completion of the Queensland compliance training module delivered through WorkPro.

3.3 You must not provide services in Queensland unless:

  • the required WorkPro training module has been completed, and

  • your training status remains current.

3.4 You acknowledge that Budget Ride may rely on WorkPro records as evidence of your compliance.

3.5 Budget Ride may require refresher or updated training through WorkPro where required to maintain compliance.

4. Booked Hire Service Licence (BHSL)

(for the purposes of clauses 7 and 19 of the Driver Terms)

4.1 You must only provide booked hire or ride-booking services in a vehicle that holds a current Booked Hire Service Licence (BHSL).

4.2 The BHSL must:

  • apply to the specific vehicle being used

  • be current and valid

  • not be suspended, cancelled, or expired.

4.3 You must carry evidence of the BHSL (physical or electronic) and produce it when required.

4.4 You must not provide services using a vehicle that does not hold a current BHSL.

5. Vehicle registration, inspection and insurance

(for the purposes of clauses 7, 8 and 19 of the Driver Terms)

5.1 Vehicles used to provide services in Queensland must:

  • be registered in Queensland

  • have the correct purpose of use recorded for booked hire services

  • have the correct CTP insurance class

  • meet all Queensland vehicle standards for personalised transport services.

5.2 Unless exempt, vehicles must have a current Certificate of Inspection (COI).

5.3 You must not provide services if the vehicle:

  • is not registered in Queensland

  • does not have the correct purpose of use

  • does not have the correct CTP insurance

  • does not have a current COI where required

  • is unsafe or otherwise non-compliant.

6. Ride-booking identification signage

(for the purposes of clauses 11 and 19 of the Driver Terms)

6.1 When your vehicle is being used to provide ride-booking services in Queensland, it must display the approved ride-booking service identification signs.

6.2 You must not create, modify, or substitute your own signage.

6.3 Budget Ride will provide the required approved signage, including as part of onboarding.

6.4 You must display the signage:

  • on the front windscreen in the prescribed position

  • on the rear windscreen in the prescribed position.

6.5 You must remove the signage when:

  • you are not providing ride-booking services, or

  • the vehicle is being used for personal or non-booked hire purposes.

6.6 Failure to correctly display approved signage while in service is a breach of these Terms.

7. Fares and receipts

(for the purposes of clauses 12 and 19 of the Driver Terms)

7.1 You must provide a fare estimate before a journey starts, unless a lawful exception applies.

7.2 If requested, you must provide a receipt that includes an itemised breakdown of the fare and any applicable surcharges.

8. Driver conduct, fatigue, alcohol and drugs

(for the purposes of clauses 14 and 19 of the Driver Terms)

8.1 When providing services in Queensland, you must:

  • have a zero blood alcohol concentration

  • not be under the influence of drugs

  • not operate while fatigued or otherwise unfit to drive.

8.2 You must immediately cease providing services if you are impaired or fatigued.

9. Enforcement (Queensland)

9.1 Budget Ride may immediately suspend or terminate your access to the Platform for Queensland operations if you:

  • do not hold a current BHTX Driver Authorisation

  • have not completed or maintained required WorkPro training

  • operate without a current BHSL

  • operate a non-compliant vehicle

  • fail to correctly display approved signage

  • otherwise breach this Schedule or Queensland law.

9.2 No compensation is payable for suspension or termination arising from Queensland-specific compliance enforcement.
