These Rider Terms and Conditions (“Terms”) govern your access to and use of the rider-facing services, including the Budget Ride mobile application, website, and related technology (the “Rider App” or “Platform”) operated by Budget Ride Pty Ltd (“Budget Ride”, “we”, “us”, “our”).

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and any supplemental policies referenced in these Terms (together, the “Agreement”). If you do not agree, do not use the Platform.

1. Definitions and structure

1.1 Platform

Booking means a request you place through the Platform for transportation services.

Driver means an independent third-party provider who offers transportation services to riders.

Ride Services means transportation services provided by a Driver to you.

Fees means all charges associated with a Booking, including fares, tolls, surcharges, service fees, cancellation fees, waiting time fees, cleaning fees, and damage fees (where applicable).

Content includes text, images, ratings, reviews, feedback, and other materials.

2. The Platform is a technology service

2.1 Marketplace model

Budget Ride provides a technology platform that enables you to request Ride Services from independent Drivers. Budget Ride is not itself a transportation provider, taxi operator, or carrier, and does not provide Ride Services. Drivers provide Ride Services directly to you.

2.2 No guarantee of availability

We do not guarantee that Drivers will be available at any given time or that a Driver will accept your Booking.

3. Eligibility and account registration

3.1 Age and capacity

You must be at least 18 years old to create an account unless we expressly allow a teen/minor account type in your jurisdiction with required guardian involvement.

3.2 Accurate information

You must provide accurate, current information and maintain it. You are responsible for all activity on your account.

3.3 Security

Keep your login credentials secure. Notify us immediately if you suspect unauthorised access.

4. Using the Platform

4.1 Lawful use

You must use the Platform lawfully and not for any improper purpose, including harassment, discrimination, fraud, or interference with the Platform.

4.2 Your responsibilities during rides

You agree to:

  • treat Drivers with respect and avoid threatening, abusive, discriminatory, or inappropriate conduct

  • follow lawful safety instructions (including seatbelt requirements)

  • not damage the vehicle or property

  • not attempt to control or interfere with the vehicle or driving

4.3 No weapons; no illegal activity

You must not bring illegal items or engage in unlawful conduct in connection with a Booking or ride.

5. Bookings, cancellations, and waiting time

5.1 Requests and acceptance

Submitting a Booking is a request. A contract for Ride Services is formed (if at all) when a Driver accepts and provides the Ride Services.

5.2 Cancellations

If you cancel a Booking, a cancellation fee may apply depending on timing, ride type, and other factors (including if a Driver has already arrived or is en route).

5.3 Waiting time fees

If a Driver arrives and waits beyond the applicable grace period, waiting time fees may apply. Waiting time fees may begin after a short grace period and are typically charged per minute (rules vary by location/ride type).

5.4 No-show / late pickup

If you do not arrive at the pickup location within a reasonable time, you may be charged a no-show or cancellation fee and the Driver may cancel.

6. Fares, payments, and receipts

6.1 Fare calculation

Fees may include a base fare plus time/distance, plus other amounts such as tolls, airport fees, booking/service fees, or surcharges (where applicable). You will generally see an estimate before confirming. Final pricing may change due to route changes, stops, traffic, waiting time, or other trip factors.

6.2 Payment authorisation

By using the Platform, you authorise Budget Ride (and/or its payment processors) to charge your selected payment method for Fees, including adjustments, post-trip charges, and amounts payable under these Terms.

6.3 Receipts

We may provide receipts electronically (in-app or by email).

6.4 Disputes and corrections

If you believe you were charged incorrectly, you should submit a request through the in-app support flow as soon as possible. We may investigate and, where appropriate, issue a correction or refund at our discretion (subject to applicable law).

7. Cleaning fees and damage fees

7.1 You are responsible for mess and damage

If you cause a mess requiring cleaning, or damage the vehicle, you may be charged a cleaning fee or damage fee to cover the Driver’s costs and lost time.

7.2 Evidence and review

We may require evidence (for example, photos and trip details) before applying a fee, and we may offer an in-app pathway to dispute it.

8. Assistance animals and accessibility

8.1 Assistance animals are permitted

Where required by law, riders with assistance animals must not be refused service because of the assistance animal, and discrimination is prohibited.

8.2 No pet claims

An assistance animal is not the same as a pet. Separate “pet-friendly” ride options (if offered) may have different rules and fees.

9. Promotions, credits, and vouchers

9.1 Conditions apply

Promotions, credits, and vouchers may be offered and will be subject to additional terms (including expiry, eligibility, and limits). We may modify or end promotions at any time to the extent permitted by law.

9.2 No cash value

Unless required by law, promotional credits have no cash value and are non-transferable.

10. Safety, incidents, and complaints

10.1 Reporting

You should report safety issues, accidents, or serious complaints promptly through in-app support.

10.2 Investigations and cooperation

We may investigate complaints and may share information where required or permitted (including with regulators or law enforcement).

11. Communications and electronic notices

11.1 Electronic communications

You agree that we may provide notices, receipts, and other communications electronically, including via in-app notifications, email, or SMS.

11.2 Contacting support

Calls, chats, or messages with support may be monitored and recorded for quality, training, and safety purposes where lawful.

12. Privacy and location data

12.1 Privacy notice

Our handling of personal information is governed by our Privacy Notice and applicable privacy laws.

12.2 Location data

To deliver the service, the Rider App may collect and use location data (including from device settings such as GPS and nearby signals) to match you with Drivers, enable navigation, and provide trip records/receipts.

13. User content, ratings, and feedback

13.1 Your content

You may be able to submit ratings, reviews, feedback, and other Content. You must not post unlawful, misleading, abusive, or infringing Content.

13.2 Licence to use

You grant Budget Ride a worldwide, royalty-free licence to use, reproduce, display, and distribute your Content for operating, improving, and marketing the Platform, subject to applicable law.

14. Suspension and termination

14.1 Suspension/termination

We may suspend or terminate your access to the Platform immediately if we reasonably believe you have:

  • breached these Terms

  • engaged in unsafe, abusive, discriminatory, or unlawful behaviour

  • committed fraud or misused promotions/credits

  • created a safety, legal, or reputational risk

You may be able to submit ratings, reviews, feedback, and other Content. You must not post unlawful, misleading, abusive, or infringing Content.

14.2 Effect of termination

Termination may include loss of access to your account and inability to use the Platform. Fees owed remain payable.

15. Disclaimers

15.1 Platform provided “as is”

To the maximum extent permitted by law, the Platform is provided “as is” and “as available”, and we do not guarantee uninterrupted or error-free operation.

15.2 No exclusion of consumer guarantees

Nothing in these Terms is intended to exclude, restrict, or modify rights you may have that cannot be excluded under applicable law, including the Australian Consumer Law.

16. Limitation of liability

16.1 Limits apply to the Platform

To the maximum extent permitted by law, Budget Ride is not liable for indirect, incidental, special, or consequential loss arising out of or in connection with your use of the Platform or any Ride Services.

16.2 Ride Services are provided by Drivers

Because Drivers provide Ride Services directly to you, you acknowledge that issues arising from a ride may involve the Driver as the service provider. Nothing in these Terms limits non-excludable rights you have under law.

17. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Budget Ride and its officers, employees, and contractors from claims, losses, liabilities, and expenses arising out of:

  • your breach of these Terms

  • your misuse of the Platform

  • your violation of laws or third-party rights

  • your damage to a Driver’s vehicle or property.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Platform or by other reasonable means. Your continued use of the Platform after updates constitutes acceptance of the updated Terms.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia.
